Terms of Service
Please read these terms carefully before using Spell Swap.

Welcome to Spell Swap. By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the service.
Acceptance of Terms
By creating an account or using Spell Swap, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms, please do not use our service.
Account Creation and Responsibilities
Accurate Information
You must provide accurate, current, and complete information during registration. You must maintain and update your information to keep it accurate, current, and complete.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Age Requirement
You must be at least 13 years old to use Spell Swap. By using our service, you represent that you meet this age requirement.
One Account Per Person
Each person may only maintain one account. Creating multiple accounts is prohibited and may result in suspension of all accounts.
User Obligations
Lawful Conduct
You agree to use Spell Swap only for lawful purposes. You must not use the service to violate any local, state, national, or international law.
Respectful Behavior
You must treat all users with respect. Harassment, hate speech, discrimination, or abusive behavior will not be tolerated and may result in immediate account termination.
Accurate Listings
When listing cards for sale, you must accurately describe the card, condition, and price. Misrepresentation is prohibited and may result in account suspension.
Honest Trading
Complete all transactions you agree to. Backing out of agreed trades damages the community and may result in account restrictions.
Trading and Transactions
Listing Cards Accurately
All listings must accurately represent the card, including name, set, condition, and any notable features. Misleading listings are prohibited.
Fulfilling Transactions
Once a transaction is created, you must complete it in good faith. This includes communicating with the other party and arranging a meetup.
Meetup Safety
Arrange meetups in safe, public locations. We recommend game stores, coffee shops, or other public venues. Spell Swap is not responsible for meetup safety.
Card Verification
Both parties should verify card condition before completing the trade. Once completed, the transaction is considered final.
Prohibited Activities
The following activities are strictly prohibited on Spell Swap:
- Listing counterfeit or fake cards as genuine
- Fraudulent or deceptive practices
- Harassment, hate speech, or discriminatory behavior
- Spam or unsolicited commercial messages
- Attempting to circumvent payment processing
- Using the platform to sell illegal items
- Creating multiple accounts to manipulate the system
- Sharing account credentials with others
Intellectual Property
Platform Content
Spell Swap and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws.
User Content
You retain ownership of content you submit, such as collection data and messages. By submitting content, you grant us a license to use, display, and distribute it as necessary to provide our services.
Magic: The Gathering
Magic: The Gathering is a trademark of Wizards of the Coast. Spell Swap is not affiliated with, endorsed by, or sponsored by Wizards of the Coast.
Platform Fees and Payments
No Platform Fees
Spell Swap is currently free to use. There are no listing fees, transaction fees, or platform commissions. We reserve the right to introduce fees in the future with advance notice.
Payment Processing
Payments are processed through Stripe Connect. Stripe may charge payment processing fees. These fees are determined by Stripe and are not controlled by Spell Swap.
Refunds
Refunds are handled on a case-by-case basis. Contact support if you need to request a refund. We reserve the right to deny refund requests for completed transactions.
Limitation of Liability
To the maximum extent permitted by law, Spell Swap shall not be liable for:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Issues arising from meetups or in-person interactions
- Disputes between users
- Service interruptions or technical issues
Our total liability shall not exceed the amount you paid, if any, to use the service in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Spell Swap, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.
Termination of Service
Voluntary Termination
You may terminate your account at any time by going to Settings > Account. All your data will be permanently deleted.
Involuntary Termination
We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our sole discretion.
Effect of Termination
Upon termination, your right to use the service immediately ceases. We may retain your data as required by law or for legitimate business purposes.
Dispute Resolution
User Disputes
Disputes between users should be resolved through our messaging system. If necessary, contact support for assistance. We may mediate but are not obligated to resolve user disputes.
Binding Arbitration
Any dispute between you and Spell Swap shall be resolved through binding arbitration, except for small claims court actions. Arbitration shall be governed by the rules of the American Arbitration Association.
Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions or class-wide arbitration.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in federal or state court in King County, Washington.
Modification of Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by posting the new terms on our platform and sending an email notification. Your continued use of Spell Swap after changes constitutes acceptance of the modified terms.
